Welcome to PeakState!
These Terms of Service (“Terms”) constitute a legal agreement between you (“you” or “User”) and PeakState (“we,” “us,” or “the App”) governing your use of the PeakState mobile application and related services (collectively, the “Service”).
Important Notice: Please read these Terms carefully and make sure you fully understand them before using the Service. By tapping “Agree” or by using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, please stop using the Service immediately.
1. Description of the Service
1.1 What the Service Includes
PeakState is an AI-powered personalized energy management application. Its core features include:
- AI assistant conversations: a 24/7 intelligent energy management assistant
- Energy curve analysis: visualization of your energy fluctuations based on health data
- Sleep quality assessment: sleep data analysis and improvement suggestions
- Workload analysis: calendar density assessment and recovery time recommendations
- Screen time management: digital wellbeing analysis and usage suggestions
- Intervention toolkit: breathing exercises, focus timers, guided meditation, and more
1.2 Nature of the Service
The Service is a wellness management tool. The suggestions and analyses it provides are for informational purposes only and do not constitute medical diagnosis, treatment, or professional medical advice.

If you have any health concerns or conditions, please consult a qualified healthcare professional. PeakState accepts no liability for any health issues, losses, or damages arising from your use of the Service.
2. Account Registration and Use
2.1 Eligibility
- You must be at least 18 years of age and have full legal capacity
- Minors may use the Service only with the supervision and consent of a guardian
- You agree to provide true, accurate, and complete registration information
2.2 Account Security
- You are responsible for maintaining the security of your account, including, without limitation, safeguarding your password
- You are responsible for all activity that occurs through your account
- If you discover any unauthorized use of your account, you must notify us immediately
2.3 Account Deletion
You may delete your account at any time. Upon deletion:
- Your account information and cloud data will be permanently deleted
- You will be unable to recover any conversation records or personal settings
- Health data stored locally is managed by HealthKit and will not be deleted
3. User Conduct
3.1 You Agree Not To
- Use the Service to publish or distribute unlawful or non-compliant content
- Infringe the intellectual property rights, privacy rights, or other lawful rights of others
- Interfere with or disrupt the normal operation of the Service
- Access the Service using automated programs, crawlers, or bots
- Reverse engineer, decompile, or otherwise attempt to crack the App
- Use the Service for any commercial purpose without our prior written authorization
3.2 Enforcement
If we determine that you have violated these Terms, we may take any of the following actions:
- Issue a warning and require corrective action
- Restrict or suspend features of your account
- Terminate your account and delete associated data
- Report the matter to the relevant authorities and pursue legal remedies
4. Privacy
4.1 Privacy Policy
We take your privacy seriously. Please carefully review our Privacy Policy to understand how we collect, use, store, and protect your personal information.
4.2 Data Security
We use industry-standard security measures to protect your data, but no system can be guaranteed to be completely secure. You understand and agree that:
- Internet transmission carries inherent risks, and we cannot guarantee the absolute security of data in transit
- You should take reasonable measures to protect the security of your own devices and account
- You release us from liability for data breaches caused by force majeure events (such as hacking attacks or system failures)
5. Intellectual Property
5.1 Our Intellectual Property
The App and all of its content (including, without limitation, software, text, images, icons, interface designs, databases, and algorithms) are owned by us and protected by the copyright, trademark, and patent laws of the People’s Republic of China, international copyright conventions, and other applicable intellectual property laws and regulations.
5.2 User Content
You retain ownership of the intellectual property rights in content you create or upload while using the Service (such as conversation records and personal notes). However, you grant us the following rights:
- The right to store, process, and transmit such content as necessary to provide the Service
- The right to analyze and use anonymized data to improve the quality of the Service
5.3 Third-Party Content
The Service may include content or links provided by third parties. We are not responsible for the accuracy, legality, or reliability of third-party content.
6. Disclaimers
6.1 No Guarantee of Uninterrupted Service
We will use reasonable efforts to keep the Service stable, but we cannot guarantee that the Service will be uninterrupted. The following circumstances may cause service interruptions:
- System maintenance and upgrades
- Force majeure events (such as natural disasters, war, or government actions)
- Network failures or third-party service outages
- Hacking attacks or computer viruses
6.2 Accuracy of Content
All content provided by the Service (including AI-generated suggestions) is for informational purposes only. We do not warrant that it is fully accurate, reliable, or suitable for your specific circumstances. You should:
- Independently evaluate and verify the information provided by the Service
- Not rely on the Service’s suggestions as your sole basis for decision-making
- Consult a qualified healthcare professional for any significant health concerns
6.3 Third-Party Services
The Service relies on the following third-party services, and we are not responsible for their availability or accuracy:
- Anthropic Claude API (AI conversations)
- Apple HealthKit (health data)
- Apple WeatherKit (weather data)
7. Limitation of Liability
7.1 Limitation of Damages
To the maximum extent permitted by law, we shall not be liable for:
- Any direct, indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service
- Losses arising from data loss, business interruption, or loss of profits
- Losses caused by interruptions or failures of third-party services
- Losses caused by force majeure events
7.2 Liability Cap
If we are found liable, our total liability shall not exceed the total amount of fees you paid for the Service during the preceding 12 months. If the Service was provided to you free of charge, our total liability shall be capped at RMB 100.
8. Paid Services (Where Applicable)
8.1 Subscriptions
The Service may offer paid subscription features (such as premium membership). Subscription details include:
- Subscription periods: monthly, annual, and other terms
- Automatic renewal: subscriptions renew automatically unless you cancel
- Price changes: we may adjust prices, with adjusted prices taking effect in the next billing cycle
8.2 Refund Policy
- Subscription fees are processed through the Apple App Store, and refunds are governed by Apple’s refund policies
- To request a refund, please contact Apple Support
- We are unable to process refund requests directly
8.3 Free Trials
We may offer free trial periods. When a trial period ends, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
9. Changes to and Termination of the Service
9.1 Service Changes
We reserve the right to change, suspend, or discontinue all or part of the Service at any time. We will make reasonable efforts to notify you in advance, although advance notice may not be possible in emergencies.
9.2 Termination
You may stop using the Service and delete your account at any time. We may also terminate your account if:
- You violate any provision of these Terms
- You have not used the Service for an extended period (more than 180 days)
- We decide to discontinue the Service
9.3 Effect of Termination
Upon termination:
- You will no longer have the right to use the Service
- We may delete your account and cloud data
- Subscription fees already paid are non-refundable (except as otherwise required by law)
10. Governing Law and Dispute Resolution
10.1 Governing Law
The formation, performance, interpretation, and dispute resolution of these Terms shall be governed by the laws of the People’s Republic of China (excluding its conflict-of-laws rules).
10.2 Dispute Resolution
Any dispute between you and us shall first be resolved through good-faith negotiation. If negotiation fails, either party may bring an action before the people’s court with jurisdiction over our place of domicile.
11. Miscellaneous
11.1 Amendments
We reserve the right to amend these Terms at any time. Amended Terms will be published in the App and take effect on the date of publication. Your continued use of the Service constitutes acceptance of the amended Terms.
11.2 Severability
If any provision of these Terms is held invalid or unenforceable, that provision shall be construed as a valid provision that comes as close as possible to its original intent, and the remaining provisions shall remain in full force and effect.
11.3 Entire Agreement
These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding your use of the Service, and supersede any prior oral or written agreements.
11.4 Language
These Terms are prepared in English. Where translations into other languages are provided for convenience, the English version shall prevail in the event of any inconsistency.
